The Federal Hemp Deadline Is Approaching
A major change to the federal definition of hemp is scheduled to take effect on November 12, 2026. If Congress does not act, online THCA flower access could be sharply restricted nationwide.
The deadline is real. The two-year extension is not guaranteed. Customers and businesses need to speak up now.

S. 3686 and H.R. 7024 would provide two additional years for Congress to develop permanent hemp rules.
What Would the Hemp Planting Predictability Act Do?
The bipartisan Hemp Planting Predictability Act has been introduced as S. 3686 in the Senate and H.R. 7024 in the House. The bills would delay implementation of the new federal hemp provisions until November 12, 2028.
The extension would not permanently settle the future of THCA flower, and it does not currently guarantee protection for any individual company. It would give lawmakers, regulators, farmers, laboratories, businesses, and consumers time to build a workable system instead of facing an abrupt nationwide change.
Why This Matters Nationwide
States have already adopted different hemp rules. A sudden federal change could affect American farmers, testing laboratories, processors, warehouses, carriers, retailers, adult consumers, interstate supply chains, and lawful international business relationships. Clear federal standards are needed, but responsible regulation should not erase established compliant businesses without a fair transition.
What Congress Needs to Do
First, pass the two-year extension. Then create permanent rules that protect naturally occurring, independently tested THCA flower and preserve lawful online, interstate, and international hemp commerce.
Enforcement should focus on unsafe chemically converted intoxicants, mislabeled products, high-potency cannabinoid drinks, inadequate testing, and products marketed to children. Any permanent framework should also include a fair grandfathering, licensing, or transition pathway for established compliant businesses.
