Terms Sections
1. Agreement to These Terms
This website is operated by Frisco Labs. Throughout these Terms, “Frisco Labs,” “we,” “us” and “our” refer to Frisco Labs and its authorized representatives.
By accessing FriscoLabs.com, creating an account, submitting information, applying for wholesale access or placing an order, you agree to these Terms and the policies incorporated by reference.
If you do not agree, do not use the website, create an account or purchase products through the services.
2. Age, Eligibility and Customer Responsibility
Frisco Labs products and purchasing services are intended only for adults who are 21 years of age or older. By entering the website, creating an account or placing an order, you represent that:
- You are at least 21 years old and legally able to enter into a binding agreement.
- The account, billing, shipping and verification information you provide is accurate and belongs to you.
- You are authorized to use the selected payment method.
- You are legally permitted to purchase, possess, receive and use the products at the destination provided.
- An eligible adult will be available to accept and sign for the shipment.
Laws and restrictions can vary by state, county, city and country and may change. Customers are responsible for reviewing the requirements that apply to their purchase and destination before ordering.
Frisco Labs may request age, identity, payment, address or business verification and may decline an order that cannot be verified or lawfully fulfilled.
3. Customer Accounts and Account Security
Customers are responsible for maintaining the confidentiality of their login information and restricting unauthorized access to their accounts. Account information must remain complete and current.
You are responsible for activity completed through your account unless you promptly notify Frisco Labs of suspected unauthorized access.
Frisco Labs may suspend, restrict or close an account associated with fraud, abusive conduct, policy violations, repeated payment disputes, unauthorized use or activity that may expose Frisco Labs or another party to risk.
4. Products and Product Information
Product availability, strains, batches, pricing, quantities, photographs, packaging and descriptions may change without notice.
Hemp flower and other plant-based products vary naturally. Differences may occur in color, appearance, bud size, structure, density, trim, aroma, terpene profile, moisture, cure and cannabinoid results between individual items and batches.
Photographs are intended to represent a product or batch but do not guarantee that every individual item will appear identical. Screen settings, lighting and natural variation may affect appearance.
Certificates of Analysis and laboratory information are provided where applicable. Results may differ between samples, laboratories and batches and do not guarantee a particular individual experience.
5. Availability, Pricing, Promotions and Website Errors
Frisco Labs may change prices, quantities, promotions, discounts, eligibility requirements or availability without prior notice.
Submitting an order does not guarantee acceptance or inventory availability. Every order remains subject to payment approval, verification, inventory confirmation and fulfillment review.
We may correct typographical errors, inaccurate information, pricing errors, discount errors and inventory errors at any time. If an accepted order is affected by a material error, Frisco Labs may contact the customer, correct the order or cancel and refund the affected transaction.
Promotional offers cannot be combined unless expressly stated. Discounts have no cash value and may be limited, modified or withdrawn where permitted.
6. Order Acceptance, Refusal and Cancellation
Frisco Labs may refuse, limit, hold or cancel an order for reasons including:
- Unavailable inventory or quantity limitations
- Payment decline, processing problems or suspected unauthorized payment use
- Incorrect, incomplete or inconsistent billing or shipping information
- Failed age, identity, address or business verification
- Suspected fraud, resale risk or policy abuse
- Pricing, discount or inventory errors
- An unsupported or restricted shipping destination
- Violation of these Terms or another Frisco Labs policy
Customer cancellation or order-change requests must be submitted promptly. Changes and cancellations cannot be guaranteed after processing, packing or fulfillment has started. Once a package has been transferred to the carrier, the order cannot be canceled as an unshipped order.
7. Payments, Manual Payments and Verification
By submitting payment, you represent that you are authorized to use the selected payment method and authorize Frisco Labs and its payment providers to process the transaction.
Billing information may be required to match information maintained by the card issuer or financial institution. Some orders may also require matching or separately verified shipping information.
Failed payment attempts may result in temporary authorization holds. The customer’s bank or payment provider controls when a hold is released.
Frisco Labs may request identification, address confirmation, limited payment verification or business documentation for unusual, high-value or higher-risk transactions. Failure to complete requested verification may result in delay or cancellation.
Manual Payments
Customers using manual checkout must wait for written approval, inventory confirmation, shipping confirmation and an exact total before sending payment. A manual payment does not guarantee acceptance when the amount differs from the approved total, products are no longer available or required verification is not completed.
Payment Disputes and Chargebacks
Customers should contact Frisco Labs and provide a reasonable opportunity to investigate an order, delivery or product issue before filing a payment dispute. A payment dispute does not replace an applicable carrier investigation, return authorization, product return or inspection requirement.
If a dispute is filed, Frisco Labs may provide the payment processor, financial institution or reviewing service with relevant account, verification, order, payment, fulfillment, tracking, signature, delivery and customer-communication records.
8. Shipping, Tracking and Delivery
Processing and carrier transit times are estimates, not guarantees. Verification, order volume, inventory review, holidays, severe weather, carrier interruptions, customs activity and destination conditions may affect delivery.
Customers are responsible for providing a complete, accurate and deliverable shipping address. Address changes, reroutes, holds or delivery changes cannot be guaranteed after fulfillment begins and may create additional charges.
Tracking is provided after a shipping label is created. “Label Created” does not necessarily mean the carrier has completed its first physical acceptance scan.
Carrier tracking, acceptance scans, signature records, delivery photographs, GPS or location information, access-point records, carrier holds, reroute requests and investigation results may be used to confirm shipment activity or delivery.
Shipping and delivery are governed by the Frisco Labs Shipping Policy.
9. Adult Signature, Failed Delivery and Returned Shipments
Frisco Labs shipments require adult-signature delivery unless Frisco Labs confirms otherwise in writing. The shipment must be accepted by an eligible adult who is at least 21 years old. The customer is responsible for monitoring tracking, being available for delivery attempts and collecting any package held by the carrier before the carrier’s deadline.
Failure or refusal to sign, missed delivery attempts, failure to collect a held package, an expired carrier hold, an incorrect or incomplete address, recipient refusal or a customer-requested reroute or address change that causes the shipment to be returned does not cancel the order and is not an authorized customer return.
A refused, unclaimed or undeliverable shipment may cause Frisco Labs to incur the original outbound shipping charge, return shipping, adult-signature charges, carrier adjustments, address-correction fees, warehouse or handling costs and supplier recovery or disposition charges. These amounts are incurred because the delivery was not accepted and are nonrefundable.
At its sole discretion, Frisco Labs may permit reshipment when the package is received intact and remains eligible for shipment. Before reshipment, the customer must confirm an approved address and pay all return charges and the full cost of a new outbound shipment, including any required adult-signature service. Reshipment is not guaranteed.
This section does not apply to a verified Frisco Labs fulfillment error, verified carrier loss or damage before delivery, or a consumer right that cannot legally be waived.
10. Delivered Shipments and Carrier Documentation
A shipment marked delivered by the carrier will be treated as delivered unless a carrier investigation or other reliable documentation confirms otherwise.
Customers must promptly report a claimed loss, damage, shortage or delivery problem and preserve the shipping carton, label, packing materials, affected merchandise and all available photographs while the matter is reviewed.
Shipping Protection, when purchased and applicable, is subject to its own eligibility, documentation, reporting and investigation requirements. Shipping Protection does not guarantee an immediate refund or replacement.
11. International Orders
International shipping availability depends on the product, destination, carrier service, payment approval and order review. Frisco Labs does not guarantee customs clearance, import approval or delivery by a foreign carrier or postal service.
The purchaser and recipient are responsible for confirming all destination-country import, licensing, tax, duty, documentation and product requirements before ordering and for paying charges assessed outside the United States.
Customs inspections, seizures, import refusals, duties, taxes, warehouse charges, destination-carrier requirements and international delays are outside Frisco Labs’ direct control after export.
International sales are final after payment is processed and the order is accepted. International orders are not ordinarily eligible for cancellation, return, refund, replacement or exchange after acceptance, except where applicable law requires otherwise or Frisco Labs confirms an exception in writing.
12. Returns, Refunds and Exchanges
Return requests, product eligibility, authorization, inspection, restocking fees and refund processing are governed by the Frisco Labs Refund & Return Policy.
Authorized Customer Returns After Delivery
A return may be considered for approval only after the order has been delivered and, when required, accepted through the carrier’s adult-signature process. The customer must then contact Frisco Labs within the time stated in the Refund & Return Policy, obtain written Return Authorization and follow the provided return instructions.
To remain eligible for inspection, merchandise must be unused, unopened, untampered with, in its original packaging and returned within the authorized timeframe. Products that have been opened, used, consumed, altered, tampered with, damaged after delivery, removed from their original packaging or returned outside the authorized process are ineligible unless Frisco Labs confirms otherwise in writing or applicable law requires otherwise.
What an Approved Refund Means
Return Authorization permits the customer to send eligible merchandise for inspection; it does not guarantee a refund. A refund becomes approved only after Frisco Labs receives and inspects the authorized merchandise and confirms approval in writing.
An approved refund may remain subject to applicable restocking fees, nonrefundable original shipping charges, customer-paid return shipping, processing costs and other deductions stated in the Refund & Return Policy.
Refused, Unclaimed or Carrier-Returned Packages
Refusing delivery, failing to provide the required adult signature, missing delivery attempts, failing to collect a carrier-held package or allowing a shipment to be returned to sender is not the same as completing an authorized return after delivery.
These shipments are governed by Section 9 above and are not eligible for a refund, exchange, store credit or replacement, even when the carrier returns the package sealed or unopened.
13. Wholesale Accounts and Resale Purchases
Wholesale access, approval, inventory and pricing are not guaranteed and may be changed, suspended or withdrawn. Wholesale account access is limited to the approved customer and may not be transferred.
Wholesale customers are responsible for:
- Providing accurate identity and business information
- Maintaining any required licenses, permits or registrations
- Handling resale taxes, labeling and customer disclosures
- Reviewing product and batch information before resale
- Following all destination and resale requirements
- Maintaining appropriate storage, handling and inventory controls after delivery
Wholesale pricing, strain availability and quantities may change without notice. Products are not reserved until the order and payment are accepted or Frisco Labs confirms a reservation in writing.
14. Website and Educational Information
We work to maintain accurate website information, but content may contain errors, omissions or outdated details. Frisco Labs may correct or update website content at any time.
Educational pages, strain information, glossary entries, legal summaries and general product explanations are provided for general informational purposes and are not medical, legal, tax, financial or other professional advice.
15. Intellectual Property
Frisco Labs website content—including text, photographs, graphics, logos, product descriptions, databases, page designs and other original materials—is owned by or licensed to Frisco Labs and is protected by applicable rights.
You may not copy, scrape, reproduce, republish, distribute, sell, impersonate or commercially exploit protected website content without written permission. Limited personal use is permitted only when it does not violate these Terms or another party’s rights.
16. Reviews, Photographs and Customer Submissions
If you submit a review, comment, photograph, testimonial or other material, you represent that you have the right to submit it, that it reflects your honest experience or opinion and that it is not knowingly false, misleading, unlawful, abusive or infringing.
When a review or submission is connected to a discount, free product, bonus or other incentive, that connection must be clearly disclosed.
To the extent permitted by law, you grant Frisco Labs a non-exclusive, worldwide, royalty-free license to reproduce, publish, display and use submitted content in connection with its website, products, customer service and marketing.
Frisco Labs may moderate or remove submissions that violate these Terms, disclose personal information, are unrelated to the product or appear fraudulent. Frisco Labs does not require a positive review as a condition of an incentive.
17. Third-Party Services and Links
Frisco Labs uses and may link to third-party payment processors, carriers, verification providers, analytics services, social networks and technology platforms.
Third-party services are governed by their own terms and privacy practices. Frisco Labs does not control and is not responsible for third-party websites, outages, decisions, content or independent practices.
18. Prohibited Uses
You may not use the website, accounts or services:
- For unlawful, fraudulent or unauthorized activity
- To submit false identity, age, payment, order or delivery information
- To interfere with website security or operation
- To introduce malware or malicious code
- To scrape, copy or impersonate protected content for unauthorized commercial use
- To violate intellectual-property, privacy or publicity rights
- To threaten, harass or abuse customers, employees or service providers
- To manipulate accounts, promotions, discounts, reviews, refunds, delivery claims or payment disputes
Frisco Labs may restrict access, cancel orders and preserve or provide relevant records when unlawful activity or misuse is reasonably suspected.
19. Disclaimer of Warranties
To the fullest extent permitted by law, the website, services and products are provided on an “as is” and “as available” basis. Frisco Labs does not guarantee that the website will be uninterrupted, error-free or free from harmful components.
To the fullest extent permitted by law, Frisco Labs disclaims express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing in these Terms excludes a warranty or customer right that cannot lawfully be excluded.
20. Limitation of Liability
To the maximum extent permitted by law, Frisco Labs and its affiliates, owners, officers, employees, agents, suppliers and service providers will not be liable for indirect, incidental, punitive, special or consequential damages arising from the website, services, products or third-party services.
This includes loss of profits, revenue, business opportunity, goodwill, data or replacement costs, even when the possibility of such damages has been advised.
Except where prohibited by law, aggregate liability arising from an affected order will not exceed the amount actually paid to Frisco Labs for that order. Where liability cannot be excluded or limited in this manner, it will be limited to the maximum extent permitted by applicable law.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Frisco Labs and its affiliates, owners, officers, employees, agents, contractors, licensors, service providers and suppliers from third-party claims arising from:
- Your material breach of these Terms
- Your unlawful or unauthorized use of the services
- Your violation of another person’s rights
- False information supplied through your account or order
- Your resale, relabeling, storage, handling or unauthorized modification of products
22. Suspension and Termination
Frisco Labs may suspend or terminate access to an account or the services when we reasonably believe the user has violated these Terms, misused the website or engaged in unlawful, fraudulent, threatening or abusive conduct.
Provisions that by their nature should survive termination—including payment obligations, intellectual-property rights, disclaimers, limitations, indemnification and governing-law provisions—will remain effective.
23. Governing Law, Severability and Waiver
These Terms and agreements through which Frisco Labs provides the services are governed by the laws of the State of California, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.
If a provision is determined to be invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure by Frisco Labs to enforce a provision does not waive the right to enforce it later.
These Terms and the policies incorporated by reference form the agreement governing use of the services, except where Frisco Labs and a customer enter a separate written agreement. Nothing in these Terms removes a right that cannot lawfully be waived.
24. Changes to These Terms
Frisco Labs may update these Terms when business practices, services, technology, policies or applicable requirements change. The updated version will be published on this page with a revised “Last updated” date.
Updated Terms apply prospectively from their effective date. Continued use of the services after updated Terms become effective constitutes acceptance to the extent permitted by law.
25. Incorporated Policies
The following Frisco Labs policies are incorporated into or related to these Terms:
